A. The notary will witness your signature and affix his seal of office at his sole discretion. If the notary prepares any documents, he will rely on the information you give him. You are responsible for any errors and omissions in that information.
B. You confirm that you have read and understood all the documents that the notary will sign and that, where you sign documents, by signing them you intend to give them legal effect. You acknowledge that the notary is acting as a witness only; the notary is not a party to any transaction.
C. You verify that all documents and the facts contained in them are true and authentic. You declare that, so far as you are aware, the documents are not being executed as part of, or as a plan for, any illegal act in any country.
D. You understand that the notary must keep records in a formal register and must make and keep copies of the relevant pages of your passport and other identification records; likewise, the notary may keep copies of all notarised and supporting documents. You consent to such record-keeping and all such copying and retention. This copied information is not disclosed any other parties, save as permitted or required by applicable laws and regulations.
E. If you instruct the notary to forward or email any documents after notarisation, this will be at your sole risk. If you instruct the notary to use legalisation agents, he will not be liable in respect of any services provided by them.

G. Limitation of liability: The sum currently insured under the applicable professional indemnity insurance policy for this notarial practice is One Million pounds sterling. The total liability of the notary to you in respect of all losses arising under or in connection with this retainer (whether for breach of contract, breach of statutory duty, tort, negligence, or otherwise howsoever) shall not exceed One Million pounds. The notary shall not be liable (i) for any loss of profit, loss of business, business interruption, loss of business opportunity, or (ii) for any indirect or consequential loss arising under or in connection with this retainer.
Notwithstanding the above, this limitation of liability clause shall not apply in the event of (i) death or personal injury caused by the negligence of the notary, (ii) fraud or fraudulent misrepresentation of the notary, (iii) where you are receiving notarial services as a consumer (ie where you are not acting in the course of a trade, business or profession), or (iv) any matter in respect of which it would be unlawful for the notary to exclude or restrict liability.
